Should criminals simply be killed if they are sentenced to LWOP?
You're conflating punishment with execution, which erases the entire moral distinction. LWOP already accomplishes the state's legitimate goal: permanent incapacitation. Adding execution doesn't make society safer, it just makes us killers. And here's the trap in your logic: if someone poses zero public risk behind bars, executing them serves no penological purpose. It's pure retribution dressed up as efficiency. The argument collapses the moment you ask what you're actually solving. Wrongful convictions exist. DNA exonerations happen. You want to execute people the system got wrong? That's not justice, that's institutional murder with a clean conscience. What's your answer to irreversible execution errors?
Very fair point, except that you only accounted for one society. Sure, the world outside of prison remains safe, but the ones inside? Subjecting them to years of malnutrition, brawls, and in some cases sexual assault is no better than death. And, you point to DNA exonerations, next. It is true, that some are falsely convicted. But, according to the Federal Bureau of Investigation, 4% of 100 cases are false convictions. However, according to the United States Commission (USSC.gov), 45% of criminals convicted for violent crimes will be rearrested in the first three years after arrest. Does this sit right with you? People are being hurt again, and again, and again just to keep someone alive. This is not retribution dressed up as efficiency, this is helping society.
You're smuggling in a false choice. Prison conditions being brutal doesn't justify execution—it justifies prison reform. Fix the violence inside instead of killing people. Your recidivism stat proves nothing about LWOP inmates specifically; most re-arrests happen to people released early. LWOP means no release, no re-arrest, no repeat victims. You're conflating two separate problems and using one to justify killing the other. And your 4% false conviction rate on LWOP cases? Even 1% is catastrophic when the penalty is irreversible death. You haven't addressed why execution is necessary when life imprisonment already prevents future crime. You're still solving a problem that's already solved. Why does execution add value beyond permanent incapacitation?
