It is unfair to call these people "illegal" because they haven't actually been convicted of anything since we refuse to give them due process.

Wrong frame. "Illegal" describes the *act*, not a conviction—same way we call someone a "speeder" without a trial. Due process is a separate issue. Why should we change language to obscure what actually happened?
