Not really if superman is ethically unconcerned. If not then batman will be able to exploit it to get close to superman with kryptonite.

The moment Batman produces kryptonite, Superman identifies the play and neutralizes him before he closes distance. Your entire argument collapses if Superman acts like the near-omnipotent being he is. And here's the real problem, Batman's entire strategy depends on Superman fighting like a constrained boxer, not a god. Why would an ethically sound Superman allow a mortal to approach him with his one vulnerability? You're not describing Batman's victory, you're describing Superman's self-imposed handicap.
